This agreement is between The Party Pond (Poppy Jade LLC) and the client named below. By signing, you acknowledge that you have read, understand, and agree to all terms.
A non-refundable retainer is required to secure your event date. Your date is not held until the signed agreement and retainer are received. The remaining balance is due 7 days prior to your event.
Cancellation policy: Cancellations 14+ days before the event forfeit the retainer only. Cancellations 7β13 days before forfeit 50% of the total balance. Cancellations less than 7 days before are subject to the full balance. No refunds will be issued under any circumstances.
If you need to reschedule, we will do our absolute best to accommodate a new date within 1 year of the original event date, subject to availability. Rescheduling must be requested in writing and is not guaranteed.
Balloons placed outdoors have their own personality β especially in Florida. We use only 100% biodegradable Sempertex and Tuftex latex balloons. For outdoor installs, we intentionally under-inflate each balloon to allow for natural expansion in heat. We have an excellent success rate with installs in shade or out of direct sunlight. We cannot guarantee the longevity of outdoor decor beyond completion of the installation. Florida weather and outdoor conditions are beyond our control once we have departed.
In the event of severe weather (hurricanes, tropical storms, extreme wind or lightning) or any other act of God that makes it unsafe or impossible to complete the installation, The Party Pond reserves the right to postpone or modify the install. No refunds will be issued under any circumstances, including acts of God. All payments are non-refundable.
The client may reschedule within 1 year of the original event date, subject to availability. We will do our absolute best to accommodate. Any rescheduling request must be made in writing.
We take extreme care securing all backdrops. However, we cannot guarantee that backdrops will remain standing in outdoor environments. Wind and outdoor conditions are beyond our control. If outdoor weather is a concern, please discuss alternative placement with us in advance.
Our marquee letters and numbers are water-resistant but not waterproof. They must be unplugged from the main power source after your event β only from the wall outlet, never from the marquee unit itself. If you have 4 or fewer marquee pieces and rain is expected, they must be moved indoors or under cover. By signing, you agree to take responsibility for this.
Vinyl decals are placed on a clear plastic balloon over the latex balloon for the best adhesion. We cannot guarantee that vinyl decals will permanently adhere, and we cannot guarantee the balloon will not pop after we have left the event.
Latex balloons naturally lose their shine over time. If you request our Hi-Shine professional spray treatment, please be aware: overspray can occur despite drop cloths being used; shine spray may create a slippery residue on hard floors; shine may transfer onto clothing if guests contact treated balloons. We cannot be held responsible for clothing or surface contact with shine-treated balloons. This is common practice and these situations are rare β by requesting shine, you agree to these terms.
Our installations use natural rubber latex balloons. Individuals with latex allergies should avoid direct contact with balloons. The Party Pond is not liable for allergic reactions at the event. Balloons are also a choking hazard β adult supervision is required around young children at all times.
All non-balloon equipment (backdrop frames, poles, marquee letters/numbers, lighting, etc.) remains the property of The Party Pond and must stay on-site until our scheduled pickup. The client is responsible for the safekeeping of all equipment from installation until our return. Any equipment that is damaged, stolen, or lost will be billed to the client at the full original purchase price β the actual amount paid by The Party Pond to acquire the item new.
The Party Pond team does not move furniture. The agreed-upon space must be fully cleared and ready upon our arrival. Any wait time caused by an unready space will incur a fee of $50 per 15 minutes.
Final approval: Before we leave the event, we will send photos and/or video of the completed installation to the client or their designated contact for review and approval. Any concerns must be communicated immediately while our team is still present.
The Party Pond is the exclusive balloon and decor provider for this event. No other individual or company may provide balloon decor at the same event without our prior written consent. If this clause is violated, we reserve the right to stop work and leave, and the retainer will not be refunded.
If a specific balloon color or product becomes unavailable, The Party Pond reserves the right to substitute an item of like kind and quality. We will notify you of any significant substitutions as early as possible.
The Party Pond reserves the right to photograph and video all installations for use in our portfolio, website, and social media. If you prefer your event not be featured publicly, please notify us in writing before your event date and we will honor that request.
The Party Pond's liability is limited to the total amount paid for services under this agreement. We are not responsible for indirect, incidental, or consequential damages, or for accidents caused by mishandling or unauthorized use of decor by guests or site staff after installation is complete.
We arrive with all decor already inflated, prepped, and ready to install. Five years in business β we have never not completed a job before guests arrive. Your event is in the best possible hands, and we take that responsibility seriously every single time.
